A legal disclaimer

Information We Collect: We collect information from businesses seeking loans and from individuals associated with those businesses (e.g. owners, officers, guarantors). This includes business data (e.g. company name, Employer Identification Number, financial statements, tax returns, bank account and payment history) and personal data (e.g. names, contact details, Social Security numbers or Tax ID numbers, credit history and scores of individuals, and personal financial information). Many of these are considered nonpublic personal information under GLBA (personal financial data and similar identifying information). We collect data when clients submit loan applications and documents (often through our secure cloud-based CRM, e.g. Salesforce) or via email/phone forms.

How We Use Your Information: We use collected data solely to evaluate and facilitate loan applications. Specifically, we use business and financial data to assess creditworthiness, verify identities, perform risk assessments, and match clients with suitable lenders. We may also use contact information to communicate with clients about loan opportunities or servicing. We do not use personal data for unrelated marketing, and we do not sell consumer personal information. The data we collect is retained only as long as needed for these purposes (see Data Retention below).

Data Sharing and Disclosure: Trustify shares personal and business information only as necessary to provide our services. This typically means providing requested data to potential lenders or financial institutions in order to pursue loan funding, and to our trusted service providers (e.g. IT/CRM support, document processors) under strict confidentiality agreements. We ensure that all third parties maintain appropriate security safeguards. Under GLBA’s Privacy Rule, we will inform customers about our sharing practices and provide a way to opt out of certain disclosures to non-affiliated third parties. (Note: sharing data with lenders to fulfill a loan request generally does not require a separate opt-out, but we still notify clients how their information will be used.) We will never sell personal data, and we limit data sharing to the minimum required.

Your Rights: Clients and individuals have rights regarding their data. You have the right to access and correct your personal information held by Trustify. We honor requests to update inaccurate information. Where permitted by law, you may request deletion of your data (for example, under California’s privacy laws). California residents have additional rights under the CCPA/CPRA – such as the rights to know what information we collect, to request deletion of personal data, and to opt out of any sharing or “sale” of data. (CCPA also prohibits discrimination for exercising these rights.) We will respond to verified privacy requests in accordance with applicable law. If you are a business owner or officer, you have a right to review the information Trustify maintains about you.
